General Terms for LeadsDatabase.com
In this agreement (the “Agreement”), the words “you” and “your” refer to the party using the LeadsDatabase.com data.
All of LeadsDatabase.com Email Lists and Mailing Lists are collected from public sources seeking exposure. So by purchasing our database, you must comply and abide by the CAN SPAM ACT of 2003.
Your Responsibilities: 1. You will not use any LeadsDatabase.com data for any purpose(s) that violate the CAN SPAM ACT of 2003. 2. Your use of the Data will follow all state laws, local laws, and federal laws, statues, rules and regulations, laws regarding telemarketing, email and facsimile marketing, customer solicitation, do-not-call lists, and all guidelines of the Direct Marketing Association (“DMA”). 3. You shall not name LeadsDatabase.com or refer to the use of LeadsDatabase.com data in any advertisements, promotional or marketing material. 4. You shall indemnify and hold harmless LeadsDatabase.com (Publishing Company, Inc.) and their officers and employees against any loss, liability, damage, cost or expense (including, but not limited to, reasonable attorneys’ fees and legal costs) suffered or incurred by any Indemnified Party, arising out of or in any way related to your use of the LeadsDatabase.com data or the breach of this Agreement.
By purchasing our Database, you must agree that the use of the data found on this website is at your own risk. By using the information from our Database, you are required to indemnify and hold harmless Publishing Company, Inc. You will not hold Publishing Company, Inc. accountable if for any legal problems that will occur regarding the usage of the data. The responsibility to remain compliant with the Do Not Call and FCC laws is yours. Do Not Call laws like many other laws will be updated periodically. You are responsible to ensure that your use of our leads and lists are legal and appropriate under any Federal, FCC or State Do Not Call laws that apply. You should contact your own legal counsel if you are at all unsure about the Do Not Call legislation and how it affects your use of our leads and lists.
While LeadsDatabase.com uses different techniques to remove spam traps and bad user records we are not responsible for any damages incurred by the inclusion of spam traps, or any malicious user records, in any database sold, delivered to, or leased under this agreement.
Limitation of Liability
All database materials are provided “as is”. You agree that use of the services is at your own risk. expressly agree that Publishing Company, Inc. shall not be liable for losses, damages, or injuries of any kind, including but not limited to general, direct, special, incidental, and/or consequential damages. In no event shall LeadsDatabase.com entire liability exceed the total amount you paid to LeadsDatabase.com under this agreement.
Copyright
The User acknowledges that all data rights including without limitation copyright, shall remain the property of LeadsDatabase.com.
Under no circumstances can the data be reproduced or copied. There are hidden records that will alert of usage.
Refunds
Unfortunately we can’t offer refunds after the product has been downloaded. In the event that a refund is requested we will make every effort to work with you until you’re happy.
Data Accuracy
It’s important to note that LeadsDatabase.com cannot guarantee any sales from the use of our database. The data is not verified other than using logic to best determine validity. Another extremely important fact is that businesses change periodically and we have no control over whether the data was updated on the government site in a timely manner, or if the emails are still valid. We work our hardest to constantly update our database to make sure you get only the best leads.
Database Delivery
Once you purchase the database you’ll receive an email to download the databases. If you do not receive your database within 5 minutes of purchase, be sure to check your spam and junk folders.
